The Legal Standing of the Head of the Nusantara Capital City Authority within the Indonesian Governmental System

This research aims to analyze the legal standing of the Head of the Nusantara Capital City Authority within the Indonesian governmental system and to examine the position of the legal products issued by the Head of the Nusantara Capital City Authority within the hierarchy of laws and regulations. The research method used is normative legal research, employing the statute approach, conceptual approach, historical approach, and comparative approach. Conclusion: (1) The legal standing of the Head of the Nusantara Capital City Authority in Indonesia's governmental system represents a novel form of constitutional law in Indonesia, adopting the concept of a Special Regional Government at the provincial level with a Head of Government at the ministerial level, which is consistent with the 1945 Constitution of the Republic of Indonesia; (2) The legal products issued by the Head of the Nusantara Capital City Authority are not included in the hierarchy of laws and regulations as stipulated in Article 7, paragraph (1) of Law Number 12 of 2011 concerning the Formation of Laws and Regulations. This is because the Regulations of the Head of the Nusantara Capital City Authority are not regional legal products, but rather ministerial-level institutional regulations formed based on Law and recognized for their existence in accordance with Article 8, paragraph (1) and paragraph (2) of Law Number 12 of 2011 concerning the Formation of Laws and Regulations.
